Our attorneys have helped clients create and develop solutions of varying complexity. We assist with structuring, short- and long-term financing, and other incentives and programs, state and federal permitting, and interconnection and transmission issues. We have represented lenders in all aspects and financing of energy projects, including acquisition and transfer of facilities, acquisition of financing, and drafting and negotiating complex and sophisticated commercial agreements.  Energy projects have involved natural gas utilities, oil and gas leases and exploration, and the development of oil and gas drilling facilities.

Birch Horton Bittner & Cherot attorneys assist lenders and private investor interests in regulatory due diligence for investments in energy and utility projects. For example, we have performed regulatory due diligence for a private equity company investigating various investments in electric utility infrastructure in Alaska. BHBC analyzes regulatory risks, interprets the impacts of regulatory laws and policies, and provides strategic advice on regulatory issues. BHBC attorneys have also performed regulatory due diligence for lenders investing in other types of public utility companies, including natural gas and telecommunications.
