Energy and Public Utilities Law

Birch Horton Bittner & Cherot proactively identifies and manages the challenges posed by both federal and state regulations for electric utilities, renewable energy companies, energy infrastructure investors, public utilities and other major stakeholders.

With the knowledge of utility regulation and energy company development and operations, we help clients develop and bring new opportunities to market and navigate regulatory processes. Clients engage us for guidance and strategic direction throughout their business cycle to develop, plan, and execute on new and emerging opportunities for growth and maintain successful operations.

How We Can Help

BHBC provides a variety of other legal services to energy and utility clients, addressing issues that arise in their day-to-day operations. We serve as general counsel to utilities and provide advice in business areas including government contracts, labor, land use, zoning, government contracting, environmental, and financing issues.

BHBC has successfully negotiated an agreement with a state environmental agency preventing adverse action on alleged violations of air quality regulations, and we assisted in preventing criminal prosecution of utility executives. We have also successfully ended a utility employee labor strike and negotiated labor contract solutions for electric and other utilities. In addition, we serve as litigation counsel for utilities, handling cases that arise in business areas related to utility service, employment, contracting, acquisitions, and other areas.

Several of our attorneys have Capitol Hill and government experience, which enables us to better anticipate the potential outcomes and barriers to our clients’ goals. Our experience ranges within a variety of energy subpractice areas, including:
