Birch Horton attorneys receive defense verdict on behalf of the State

An Anchorage jury recently returned a defense verdict for Birch Horton client the Alaska Department of Corrections following a five week personal injury trial.   The plaintiff suffered from a severe medical condition, including an anoxic brain injury, which required constant care and monitoring. The case delved into complex issues surrounding inmate safety, suicide prevention, and administrative segregation policies within correctional facilities.  Life care plans for Plaintiff varied between 4.5 and 18 million dollars; Plaintiff sought a total award of 35 million dollars.   Trial involved testimony from 13 expert witnesses and 15 lay witnesses.  Partner Will Earnhart led the Birch Horton team and was assisted by Senior Counsel Zoe Eisberg and our excellent staff.
